If you find yourself in a position where you are owed money and have already tried approaching the person who owes you (debtor), you may need to issue a Letter of Demand.
A Letter of Demand aims to let the debtor know that if they don’t recompense you by a certain date, that you will consider taking legal action to recover the amount outstanding.
We understand that whether you are an agency, creator, influencer, or a brand, your needs and demands may differ. So, we have created varying letters to accommodate your every need!
This bundle includes:
- First attempt letter – a gentle reminder letting the other side know that your tax invoice is outstanding for the goods or services provided, and requesting payment of same.
- Second attempt letter – reiterating that payment has not been made in respect of the outstanding invoice and providing detail of what will happen next if payment is not made within a specific timeframe, including taking whatever action is deemed necessary.
- Third attempt letter – similar to the second attempt with more forceful language, including advising that there is no basis for resisting payment, and threatening to commence legal proceedings and recover all legal costs associated thereto if payment is not made within the requisite timeframe.
- Example Letter – we have prepared a draft First Attempt Example Letter, which will assist with the structure of these letters going forward.
Each letter has a number of placeholders for you to fill in the gaps. As we cannot determine your specific circumstances off a template document, they have not been drafted with such detail in mind and will need to be tailored by you. That being said, never fear.
